Same-Sex Marriage (Proposition 8) News

Current Status
Issuance of marriage licenses to same-sex couples is postponed until the stay is lifted, and the order invalidating Proposition 8 becomes effective.

Background
On August 4, 2010, Federal Judge Vaughn Walker entered a ruling that the ban on same-sex marriage was unconstitutional.  This ruling would have allowed same-sex marriages to proceed after 5:00 p.m. on August 18.

On August 16, 2010, the judgment was stayed (postponed) by a court order until a motion to stay pending appeal was resolved.

The appeal will be calendared during the week of December 6, 2010, at The James R. Browning Courthouse in San Francisco, California. (Refer to the order of the Ninth Circuit U.S. Court of Appeals for more information.)
